The NSW Government is currently reviewing the strata and community title laws and wants to hear your views.

A discussion paper Making NSW No. 1 Again: Shaping Future Communities was released on 15 September 2012.

Many of you contributed to the Strata Laws Online Consultation hosted by GAP from December 2011 to February 2012.

The Government’s discussion paper is the next stage in the review and builds on the comments made to the online forum. The paper looks at a wide range of topics, including the future regulatory approach, how to improve the running of schemes, managing finances, managing buildings and handling disputes.

You can download the discussion paper here. Click on the link under ‘Have Your Say’ to get to the review page.

The NSW Government will carefully consider all submissions made as part of its strata and community title law reform process.

Information on how to submit comments can be found on the front page of the discussion paper.

The Fair Trading website also has a quick survey you can complete. The closing date for comments is Thursday, 15 November 2012.

Smoking is the biggest issue and must be banned

Smoking drift from balconies and smoke coming in from ventilation and gaps in the buildings are the worst thing about living in strata. Everyday our family smokes 5 to 30 cigarettes via passive smoking from the resident below. We have tried everything with strata, the body corporate and the agent and tenant. The will enforce noise, but the refuse to accept smoke as a nuisance. The problem is we can ignore noise. But we cant stop our kids being poisoned by smoke unless we leave our unit. It must be declared a nusiance and strata and body coorporates must be told to enforce it when it is affecting non smokers.
